Abstract

This work is aimed at exploring the extent in which the International Court of Justice otherwise known as ICJ methodology in boundary delimitation resolved boundary disputes between disputing parties. The dissertation further proffered the need to embrace Joint Development (JD) through Joint Development Agreement (JDA) to delimitation by the ICJ. The ground for this argument is hinged on the unfavorable decision of the ICJ to both parties in the boundaiy delimitation of Cameroon and Nigeria and host of others. To support the objective of this work, discussion on the boundary delimitation as well as its importance and relevance to the oil and gas development, by relating in particular to the maritime boundary dispute between Cameroon and Nigeria. A discussion on the principles of international and customary law applicable in boundary delimitation and how the ICJ has disregarded the application of such principle in time past. However, with the provisions of the Geneva Convention of 1958 and the United Nations Convention on the Laws of the Sea 1982 (UNCLOS), a somewhat established pattern is created. The work further argued that despite the fact that the ICJ decision is final in boundary delimitation, it does not seem to be a panacea for maritime boundary disputes hence, JD through JDA should be encouraged amongst states with boundary disputes. The work has adopted the doctrinal method of research. It concluded by way of recommendation and way forward that in boundary disputes, except in a helpless situation that has no room of JDA, boundary delimitation should be an option of last resort.
