The Non-International Armed conflict is also govern by the law as per the provision of Article 3 Common to the Four Geneva Conventions of 1949 and the Additional Protocol II of 1977. These Laws apply only during armed violence. What qualifies a particular armed conflict situation to the status of Non-International Armed Conflict is a question of factual circumstance of a particular conflict at hand. Even after qualifying a situation as Non-International Armed Conflict, parties in an armed violence find it difficult to implement and comply with these rules. This research is aim at exposing the challenges of implementing international Humanitarian Law during armed violence not of international nature. The work aims at evaluating the challenges of the applicability of International Humanitarian Law to Non-international armed conflict. This is conflict that exist within the scope of a single state. The research work intends to depict that states can begin to do away with the culture of impunity and bring in a sustainable peace by adhering to the rules of International Humanitarian Law. The doctrinal method is the approach chosen in carrying out this research in order lo reach an understanding of the contemporary position of Non -International Armed Conflict and rules applicable lo (herein. The materials for this research work are primarily sourced from the Treaty Laws, textbooks, journals and law reports international humanitarian law. In conclusion, the research also made some recommendations.
