Item Open Access RIGHT OF SUCCESSION IN NIGERIA: A COMPARATIVE ANALYSIS OF TIV, YORUBA AND IGBO CUSTOMARY LAWS(Department of Private and Business Law, Nasarawa State Universty Keffi, 2018-11-09) Tyo, Emmanuel OraduenIt is importari&gjo note that whether by pretence or the guise of education or the tipsy effect of modernity displayed by any Nigerian or African in general, over our Customary Laws, customary practices significantly, continue to shape our laws, values and conducts in the society. Nigeria has over two hundred and fifty (250) ethics. grouQ. This makes it a multi-lingual and ethnic Nation2. As such, the right of inheritance/succession varies from one tribe to the other and the class of beneficiaries of an intestate succession more often than not is greeted with the problems of heirship and discrimination usually ventilated in the Law Court.3 It is against the backdrop of the foregoing that this work seeks to critically, consider the problems generated as a result of discrimination of succession rights under the various Customary Laws with particular and comparative reference to the Yoruba, Tiv and Igbo Customary Laws, with the mind of fishing out areas of commonalities and shocks. Above all, to wholistically examine the Supreme Court application of S.42 of the Constitution4 in its recent decision in the case ofUkeje v Ukeje (supra), to see if it is truly the antidote or a mere pain killer to the problem of succession rights and gender discrimination in Nigeria. 1
